Terms and Conditions for Amatic-Systems LLC
-
Scope of Application
The following Terms and Conditions (hereinafter "Terms") govern the contractual relationships between Amatic-Systems LLC (hereinafter referred to as "Provider") and its customers (hereinafter referred to as "Customer") in the context of contracts for products/services.
-
Subject Matter of the Contract
These Terms apply to all contracts for products/services between the Provider and the Customer, unless expressly agreed otherwise in writing.
-
Conclusion of Contract
The presentation of products/services on the Provider's website/shop does not constitute a legally binding offer but rather a non-binding invitation for the Customer to submit an offer. A contract is only concluded upon the Provider's written order confirmation or upon execution of the order.
-
Prices and Payment Terms
Prices are excluding applicable sales tax. Payment is due upon receipt of invoice. In case of payment default by the Customer, the Provider is entitled to demand statutory default interest. A deposit of 40% is to be paid, an additional payment of 40% upon completion, and the remaining 20% after delivery and configuration, unless otherwise agreed.
-
Delivery and Shipping
Delivery is made to the delivery address provided by the Customer. Shipping costs are borne by the Customer unless otherwise agreed.
-
Warranty and Liability
The Provider warrants that the products/services have the agreed-upon quality and are free from defects at the time of delivery. The liability of the Provider is limited to intent and gross negligence.
-
Right of Withdrawal
The Customer is entitled to the statutory right of withdrawal.
-
Data Protection
The Provider complies with the applicable data protection regulations.
-
Amendment of the Terms
The Provider reserves the right to amend these Terms at any time. Changes will be communicated to the Customer in a timely manner and will be deemed accepted unless the Customer objects within a reasonable period.
-
Final Provisions
Should individual provisions of these Terms be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. Swiss law applies. The place of jurisdiction is Schwyz.
